Design Of Artwork, Promotional Items,  Brochures, Flyers and Business Cards..

 

The General Process:


When you come to us for artwork, design of brochures, flyers business cards, printing etc we will communicate with you either in person, over the phone or by email. Once we mutually determine what your requirements are and have given you an estimate for the job we will ask for 100% of the costs to be paid to us.

The reason for that is simple - we have been caught out before where we spend nearly a week designing a brochure only be told by the client that he did not want it. It is impossible for any business to work that way.

At this point we will ask you to give us any photographs and content that you would like us to include in the document. 

Although we take great care of customers property whilst it is in our possession we consider anything you send to us to be sent totally at your risk and do not accept responsibility for loss or damage however caused. We will return your property via normal letter post unless specifically instructed otherwise.

Once we have done a first draft we will send it to you and ask for your input. We will take your comments on board and make the necessary adjustments. In certain situations it may be necessary to send you a second or even third draft for your comments and to ensure both parties are satisfied with the design.

 

Final Draft

 

Once both parties are satisfied with the rough drafts we will then prepare a final draft and send it to you. It is your responsibility at this point to proof that final draft and point out any spelling mistakes or grammatical errors. We will ask you to sign the final draft and the document will go to print. 

 

The responsibility for any errors in the spelling or grammar after you have signed off the final draft will be entirely yours. 

Should we make any significant error in your job that can be demonstrated as our fault then we will redo or redesign the job free of charge.

On completion of the job we will issue you an invoice for any remaining monies due.


Our Estimates:

 

Although we may give you a estimate for your job we reserve the right to adjust our price should any circumstances change that are beyond our control and effect our costs. Should this situation occur we will seek your permission before proceeding. If you refuse then we may, at our discretion, charge for the work done so far and give you any such work so that you may have the job completed elsewhere. All estimates are subject to sight of job and we reserve the right to adjust our charges should work not be as specified on our estimates.

Payment:

 

We expect 100% payment on your acceptance of our estimate for artwork and design. In the case of you just wanting materials printed we will ask for 100% of the cost of the order. Until such payments are received we will not consider any job details you send to us to constitute an order and we reserve the right not to act upon any instructions you may have given us.

Written Instructions:

 

When proofing a document we expect clear written instructions. Please type or write in capitals. We may refuse to accept liability for errors where instructions have not been clearly written down. If we are not sure on any instructions you have given us we will normally contact you to clear the matter up but to save time it is best that you give us clear instructions in the first place.

Our right to refuse:

 

We reserve the right to refuse to accept an order or to reject any partially complete order without reason given. This especially but not exclusively applies where we consider the material to be derogatory, indecent, libelous, racist, inflammatory or designed to mislead the public or promote any illegal activity.

Content:

 

Content is always a problem for graphic designers and web designers. We don't know your business so you have to tell us what you would like written on each page. We will help and advise you on how to do this and if you have the content written we will format it and include it in your document or web site free of charge. 

 

If you want us to do it then we have to make a charge simply because of the time it takes to research and get all the facts about your business.

 

If you write the content we cannot be expected to read and verify the truthfulness, honesty and legality of your copy and should the content of your job result in any court action or prosecution or liability of any kind then the responsibility is entirely yours and you agree to indemnify us fully should we incur any costs or damage in this respect.

 

 

WEB DESIGN AND INTERNET PROMOTION TERMS AND CONDITIONS

General: How It Works.

Each job and client has unique characteristics, requirements, and needs. It is important for you to provide as much information about your business or project as possible.

When you contact us regarding a project we will communicate with you by email, telephone or in person and come to an agreement as to the type of web site you should go for.

We will then give you an estimate of the costs involved.

Once you agree with the estimate we will ask you for 100% of the costs.. You will provide us with all the content and photographs that you would like to be included on the web site.

In the case of Search Engine Promotion 100% of the cost of the project is due at the beginning of the assignment. (see payment)

We will then do a rough draft to show you the graphical interface that we have designed for you. If you agree we will go ahead and complete the rest of the web site. If you don't agree with the rough draft we will work with you (within reason) to get it looking the way you want.

We don't know your business so it is up to you to write out the content on your pages. We will advise and help you with this as much as we can but you have to help us by giving us as much information as possible..

Once we have completed the project we will put it live on the internet. 

When your web site has gone live In no event will we be liable to you or any third party for any damages, including, but not limited to, service interruptions caused by Acts of God, telecommunication problems or any other circumstances beyond our control.

Payment

 

Our policy is to collect 100% of the cost of the project before starting. 

In the case of a small Content Management Web Site we will ask for 100% of the cost. The reason is simply that because of the nature of the site you will be able to update the content yourself after the initial design is done.

In the case of Search Engine Optimisation we require 100% of the cost up front.


In the event of cancellation of an assignment, a cancellation fee will be paid by the Client and will include full payment for all work completed, expenses incurred, and hours expended. The cancellation fee will be based on the prices outlined in the estimate.

Whilst any payment due under the agreement remains outstanding, we shall be entitled at our sole and absolute discretion to withhold provision of any goods or services we would otherwise be obliged to provide. We reserve the right to remove any project from viewing on the Internet until final payment is made.

Trademark And Copyright

 

You agree and warrant that any material submitted for publication or use through your account will not violate or infringe any copyright, trademark, patent, statutory, common law or proprietary rights of others, or contain anything libelous or harmful.
